POSITION SUMMARY

GGGI is seeking for an experienced environmental and public law consultant to provide in-house support to the Ministry of Environment, Water, and Ecological Transition (MAATE) in the review of legal documents and regulations developed by the Undersecretary of Natural Heritage, that contribute towards the management of different conservation mechanisms.

Responsibilities include working with MAATE’s legal team, preparing legal reports, drafting legal documents, and reviewing legal contracts. The consultant will coordinate engagement with relevant stakeholders within MAATE and implement the relevant products under the guidance and consultation of GGGI staff members.

 

PROJECT BACKGROUND

GGGI has a diverse portfolio of programs in developing countries around the world. These in-country programs, together with global products and services, focus on delivering results through an integrated approach of evidence-based green growth planning and implementation aligned to countries’ development priorities.

The achievement of Ecuador’s NDC targets requires a substantial increase in the volume of public and private, national and international climate finance invested in the country. 

As a result, the Government of Ecuador, under the leadership of MEF and MAATE, has embarked on an ambitious effort to increase the mobilization of international climate finance and implementation of innovative sustainable finance instruments to support a climate resilient and low-carbon development of the economy. 

 

OBJECTIVES OF THE ASSIGNMENT

The main objective of this consultancy is to support the legal analysis, as well as the legal documentation preparation, for the implementation of various ambitious environmental conservation strategies within Ecuador.

Specific Objectives:  Provide in-house legal technical assistance to the Ministry of Environment, Water and Ecological Transition (MAATE), specifically the Direction of Protected Areas and Other Mechanism of Conservation, in the environmental & public law aspect to implement ambitious environmental conservation strategies.

 

SCOPE OF WORK – DELIVERABLES

Deliverables and activities:

Deliverable 1:

a) Prepare a Work Plan of the activities in coordination with relevant stakeholders to undertake under the assignment tied to the specific objectives mentioned above. The Work Plan should include a timeline of main activities, methodology, milestones, validation meetings with GGGI, and description of final deliverables. The Work Plan should include the scheduling of meetings with the relevant stakeholders and their respective legal teams.

b) Read and revise documents relevant to MAATE regarding the sustainable finance instrument in question. The consultant will be asked to produce technical legal executive summary reports and PowerPoint presentations for MAATE authorities based on the documentation shared with the consultant.

c) Report: Legal Analysis of the Sustainability Commitments of the Republic

 

Deliverable 2:

d) Provide in-house support to MAATE, specifically to the Direction of Protected Areas and Other Mechanism of Conservation in the review, and co-create legal products such as reports, normative, ministerial decrees, and legal contracts determined by MAATE.

e) Assist MAATE in all tasks assigned by the authorities regarding their legal requirements for environmental conservation efforts.

f) Prepare legal reports focusing on environmental conservation efforts or commitments of the republic.

g) Provide legal technical assistance as required. 

h) Systematize all collected information, annexes, meeting minutes, etc. and consolidate it in a Final Report.

 

PAYMENT SCHEDULE

Please note that payments will be disbursed based on the successful completion (reviewed and approved by the project manager GGGI, an approval is granted once the corrections suggested in the review process are implemented) of the deliverables described above, according to the following table:

 Coordination and compliance:

  • The consultant must Sign a confidentiality agreement with the Republic of Ecuador.  

  • All relevant technical papers, reports, and other documents prepared from the start to the end of the assignment shall be attached to the final Report and must be included in a digital repository provided by GGGI.  

  • The consultant will make the best use of both primary and secondary sources of information to develop activities defined under the contract objective. 

  • The consultant selected must dedicate 100% of his/her time to this process. Therefore, it is forbidden to consider other consultancies during the contract period. 

  • This position will require a full-time on-site presence at MAATE. 

  • The consultant will work closely with GGGI staff to ensure the goals of this consultancy, and he/she will also be responsible for reporting their progress to the GGGI supervisor. 

  • The consultancy budget stated below includes the costs of transportation and accommodation, there is no additional budget that will cover required travel for the assignment. 

  • This consultancy fee is a lump sum cost.

 

EXPERTISE REQUIRED
  • Master’s Degree or equivalent combination of educational and professional experience in environmental law and Ecuadorian public law.

  • At least 5 years of relevant work experience in environmental practice and at least six months of experience working with or within MAATE.

  • Prior experience drafting interministerial agreements, ministerial normative, and reviewing complex legal documents. 

  • Knowledge of the Ecuadorian law supporting SNAP and other conservation methods

  • Environmental conservation negotiation experience is required. 

  • Fluency in Spanish and English. 

 

KNOWLEDGE AND SKILLS
  • Knowledge of Ecuadorian Environmental Law.

  • Knowledge of Ecuadorian Public Law, specifically experience working in legal matters related to environmental conservation directly with or within MAATE.

  • Strong teamwork skills and experience working in multidisciplinary groups. 

  • Verifiable experience in contract review and must be proficient in providing and implementing valuable recommendations to the draft text.  

  • Negotiation, promotion, and conflict resolution skills. 

  • Syntaxy and redaction proficiency in both English and Spanish. 

  • Meeting Facilitation Skills required.
