Purpose of consultancy

 

To support in the development and drafting of regulations under Health Services Act (29/2015).

 

 

 

 

Background  

 

Law number 29/2015 (Health Services Act), establishes a national system for providing health services in the Maldives, introducing principles related to the advancement of health services, maintaining the quality of health services provided in the Maldives, outlining the principles, standards, and conditions that health service providers in the Maldives must follow in providing services, specifying the principles, standards, and conditions that health sector workers must adhere to in providing health services, and stating the rights and responsibilities of health service providers and recipients, as well as all other related principles.

 

 

 

 

Law number 14/2024 (1st Amendment on Law number 29/2015 (Health Services Act) outlines new or existing regulations, standards, and guidelines to be formulated and revised concerning the treatments and services provided. The Consultant will work closely with the Ministry of Health to assist in drafting and amendment of the above-mentioned regulations, by engaging with key stakeholders and providing recommendations during the process.

 

 

 

 

Terms of Reference

 

  • Conduct a comprehensive review of the Law number 29/2015 (Health Services Act), Public Health Protection Act 7/2012 and 1st Amendment on Law number 29/2015 (Health Services Act).
  • Identify the new regulations to be formulated and existing regulations that require amendment (Prioritized new regulations/amendments to be drafted by consultant).
  • Engage with key stakeholders within the MoH, and other relevant government agencies and professionals within the sector to gather information and perspectives.
  • Formulate the initial draft of the regulations and submit for Ministry of Health (MOH) comments.
  • Finalize the regulations after incorporating the comments, inputs and feedback from Ministry of Health (MOH) and stakeholders.

 

 

 

Deliverables

 

  • Review Report: A detailed report reviewing the provisions of Law No. 29/2015 (Health Services Act) and its 1st Amendment and Public Health Protection Act 7/2012, highlighting key areas of change, including new regulations and amendments required along with clear justifications for each change.
  • Meeting Summaries: Records of meetings with relevant sections and professionals within the sector, including key discussion points, outcomes, and action items.
  • Initial Draft Regulations: Draft versions of the new and amended regulations developed based on the review and inputs from sector professionals, ready for Ministry of Health (MOH) review.
  • Finalized Regulations: The final version of the regulations, incorporating all the feedback and revisions suggested by MOH, ready for implementation.

 

 

 

Qualifications, experience, skills and languages

 

 

 

 

Educational Qualifications

 

Essential: Bachelor’s degree in law or relevant field

 

Desirable: Health-related field any qualification

 

 

 

 

Experience

 

Essential: Minimum of 5 years of experience in the relevant field and experience in formulating laws or regulations

 

Desirable: Past work experience in the health-related field

 

 

 

 

Skills/Knowledge

 

  • Excellent communication and interpersonal skills to effectively engage with stakeholders at all levels.
  • Ability to work independently and as part of a team.
  • Strong organizational and time management skills.
  • Proficiency in using computer software for reporting and presentation (e.g., Microsoft Office Suite, statistical software).

Essential: English – read, write, and speak at expert level

 

Divehi – read, write, and speak at expert level

Remuneration and budget (travel costs are excluded):

 

Remuneration: Pay Band level A – MVR 35,000 or MVR 40,000 per month for 6 months depending on experience)

Expected duration of contract: 6 months (26 January 2025 to 25 July 2025)

  • Please note that WHO’s contracts are conditional on members of the workforce confirming that they are vaccinated as required by WHO before undertaking a WHO assignment, except where a medical condition does not allow such vaccination, as certified by the WHO Staff Health and Wellbeing Services (SHW). The successful candidate will be asked to provide relevant evidence related to this condition. A copy of the updated vaccination card must be shared with WHO medical service in the medical clearance process.
